Do I have a Claim?
If you have been injured in an accident that was not your fault, the law makes it very clear that you have the legal right to financial compensation.
However, you will only have a claim if you meet the following two criteria:

Your accident or the date your injuries first became clear must be no more than three years ago. This is known as your Date of Limitation or Date of Knowledge. After three years, personal injury cases become time-barred or statute-barred in the UK – and you cannot bring a statute-barred case through the legal system.

You cannot be wholly responsible for the accident in which you were injured. You must always have a level of diminished liability. For example, if you were 70 per cent liable for the accident, then you can still make a claim. However, the lesser your level of liability, then the more compensation you can demand from the other side.
How much Compensation could I be Awarded?
The amount of compensation you could be awarded for your injuries depends on the extent of your injuries and how they have and will affect your life.
In addition to this, the amount of compensation you are awarded will be influenced by your level of liability, which we discussed above.
The amount of compensation you demand from the other side has to be fair and proportionate to your injuries, and your level of pain and suffering. If you demand too much the other side may contest the claim value, which will set your claim back several weeks.
In addition to physical injuries, you can also claim compensation for psychological injuries, and you can also claim back any financial losses. The compensation awarded for financial loss is known as special damages. Your total amount of compensation will be made partly of special damages. Special damages can include loss or earnings including overtime, medical expenses, travel expenses and anything else that has left you out of pocket.
